Platform: Advance Booking SA (the "Platform")

These Terms & Conditions ("Terms") govern the use of the Advance Booking SA platform by both Vendors (service providers who list and offer services) and Customers (individuals who book services). By registering, browsing, or transacting on the Platform, you agree to be bound by these Terms.


1. Nature of the Platform

1.1 Advance Booking SA is an online marketplace and booking intermediary. We connect Customers seeking services with independent Vendors who offer those services.

1.2 The Company is not a party to the underlying service agreement between a Vendor and a Customer. We do not provide, control, supervise, or guarantee the quality, safety, legality, or timeliness of any service listed or booked through the Platform.

1.3 Any dispute regarding the standard, delivery, or outcome of a service is between the Vendor and the Customer directly. The Company will act in good faith to assist with dispute resolution where reasonably possible but accepts no liability for the acts or omissions of any Vendor or Customer.


2. Vendor Terms

2.1 Registration. By registering as a Vendor, you confirm that all information provided is true, accurate, and current, and that you are legally entitled to offer the services you list.

2.2 Independent contractor status. Vendors are independent service providers and are not employees, agents, or partners of the Company.

2.3 Compliance. Vendors are solely responsible for ensuring their services comply with all applicable South African laws, licensing requirements, health and safety standards, and industry regulations.

2.4 Conduct. Vendors must not engage in fraudulent, misleading, discriminatory, or unlawful conduct on the Platform. The Company reserves the right to suspend or terminate a Vendor's account for breach of these Terms.

2.5 Booking confirmation. A booking is not automatically confirmed upon a Customer's request or payment. Vendors must review and confirm bookings following proper consultation, taking into account availability, scope, and feasibility, before the booking is treated as final.


3. Customer Terms

3.1 Bookings. Submitting a booking request constitutes an offer to engage a Vendor's services, subject to confirmation by the Vendor following consultation. A booking is only binding once confirmed.

3.2 Payments — Platform Only. All payments for services booked through Advance Booking SA must be made through the Platform's official payment system. The Company does not recognise, guarantee, mediate, or accept responsibility for any payment made directly to a Vendor outside of the Platform, and such payments fall entirely outside the protection, dispute resolution, and refund mechanisms of the Platform.

3.3 Cancellations & refunds. Customers may cancel a confirmed booking free of charge up to 24 hours before the scheduled service time, and will receive a full refund to their original payment method within 5–7 business days. Cancellations made within 24 hours of the scheduled service time, or failure to attend ("no-show"), are non-refundable. If a Vendor cancels a confirmed booking, the Customer is entitled to a full refund regardless of timing.

3.4 Accuracy of information. Customers must provide accurate contact and booking information. The Company is not liable for failed notifications or missed bookings resulting from incorrect information supplied by the Customer.


4. Payments & Fees

4.1 The Company may charge a service or platform fee on transactions, as disclosed at the time of booking.

4.2 All prices displayed are in South African Rand (ZAR). Where the Company or a Vendor is a registered VAT vendor, prices are inclusive of VAT at the applicable statutory rate. VAT invoices are available on request where applicable.

4.3 Payments are processed via PayFast, a licensed third-party payment gateway. The Company is not responsible for delays, errors, or failures caused by the payment processor.


5. Limitation of Liability

5.1 To the maximum extent permitted by the Consumer Protection Act 68 of 2008 and other applicable law, the Company excludes liability for any indirect, incidental, or consequential loss arising from use of the Platform.

5.2 Nothing in these Terms limits the Company's liability for gross negligence, fraud, or any liability that cannot lawfully be excluded under South African law.

5.3 The Company does not warrant that the Platform will be uninterrupted, error-free, or secure at all times, and will take reasonable steps to maintain service availability.


6. Personal Information & POPIA

6.1 The Company processes personal information in accordance with the Protection of Personal Information Act 4 of 2013 (POPIA). Full details are set out in our Privacy Policy, which forms part of these Terms.

6.2 By using the Platform, you consent to the processing of your personal information as described in the Privacy Policy, including sharing limited booking details with the relevant Vendor or Customer as necessary to fulfil a booking.


7. Reviews & Conduct

7.1 Customers may leave honest reviews of services received. Reviews must not be defamatory, false, or abusive.

7.2 Vendors and Customers must treat each other with respect. Harassment, discrimination, or abusive conduct through the Platform may result in account suspension.


8. Dispute Resolution

8.1 Any dispute arising from these Terms will first be addressed through good-faith engagement between the parties, facilitated by the Company where appropriate.

8.2 Unresolved disputes may be referred to the National Consumer Commission, the Information Regulator (for POPIA matters), or a competent South African court.


9. Governing Law

These Terms are governed by the laws of the Republic of South Africa. The parties submit to the non-exclusive jurisdiction of the South African courts.


10. Changes to These Terms

The Company may update these Terms from time to time. Continued use of the Platform after changes take effect constitutes acceptance of the updated Terms.
